Conshohocken Borough Council will consider the adoption of the following ordinances at its meeting on January 19, 2022, at 7:00 pm, at Borough Hall, located at 400 Fayette Street, Conshohocken, PA 19428. A copy of the ordinances under consideration can be found on the Borough’s website at the links provided below, or may be obtained by calling the Borough’s offices at 610-828-1092, by e-mailing brogers@conshohockenpa.gov, or at the Borough’s administrative offices at 400 Fayette Street, Suite 200, Conshohocken, PA 19428. Copies of the ordinance will be provided free of charge.

In accordance with the requirements of the Borough Code, the following is a summary of the proposed ordinances:

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING CHAPTER 2 ANIMALS TO ESTABLISH ADDITIONAL RULES AND REGULATIONS REGARDING THE KEEPING OF ANIMALS IN THE BOROUGH OF CONSHOHOHOCKEN; REPEALING PRIOR INCONSISTENT ORDINANCES AND PARTS OF ORDINANCES; PROVIDING FOR A SAVINGS CLAUSE; AND CONTAINING AN EFFECTIVE DATE.

The ordinance amends the Borough’s animal control regulations by adding new, and clarifying old, rules and regulations relating to animal control within the Borough.  The ordinance prohibits off-leash animals within the Borough (except on the private property of the person in possession of said animal or where specific permission has otherwise been granted to be on the private property of another).  The ordinance contains restrictions regarding animal waste and removal of animal waste.  The ordinance subjects noise generated by animals to the noise control provisions of the Borough’s ordinances. The ordinance prohibits the feeding of feral cats where such feeding causes a nuisance or creates a condition contrary to the health, safety, and welfare of the community (e.g. where a feral cat colony is created).  The ordinance contains enforcement provisions (including allowing an animal control officer to enforce the ordinance provisions), violation and penalty provisions, and authorizes private actions for enforcement of the ordinance provisions.  The ordinance contains a savings clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.

 Animal Control Ordinance

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING CHAPTER 15 VEHICLES AND TRAFFIC OF THE CODE OF THE BOROUGH OF CONSHOHOCKEN TO ESTABLISH CERTAIN 15 MINUTE “TO-GO ORDERS ONLY” PARKING IN CERTAIN AREAS OF THE BOROUGH; REPEALING PRIOR INCONSISTENT ORDINANCES AND PARTS OF ORDINANCES; PROVIDING FOR A SAVINGS CLAUSE; AND CONTAINING AN EFFECTIVE DATE.

The ordinance amends the Borough’s parking regulations to provide for certain “15 minute ‘To-Go Orders Only’” parking within the Borough, and specifically at the following locations: On the east side of Fayette Street, between East First Avenue and East Second Avenue, four parking spaces identified by posted signage.  On the east side of Fayette Street, between East Second Avenue and East Third Avenue, three parking spaces identified by posted signage.  On the north side of East First Avenue, between Fayette Street and Harry Street, one parking space identified by posted signage.  The ordinance contains a savings clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.

15 Minute To-Go Parking Ordinance

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING CHAPTER 1 ADMINISTRATION AND GOVERNMENT, PART 7 FIRE SERVICE, BY ADDING THE APPOINTED POSITION OF BATTALION CHIEF AND OTHERWISE CLARIFYING THE HIERARCHY OF AUTHORITY AS IT APPLIES TO FIRE SERVICES IN THE BOROUGH; REPEALING PRIOR INCONSISTENT ORDINANCES AND PARTS OF ORDINANCES; PROVIDING FOR A SAVINGS CLAUSE; AND CONTAINING AN EFFECTIVE DATE.

The ordinance amends the Borough’s Code of Ordinances with respect to fire service within the Borough.  The ordinance clarifies the organizational structure of the Borough’s fire department, including the chain of command (both on scene and where the Fire Chief is absent from the Borough for more than 24 hours).  The ordinance addresses and/or adds the positions of Deputy Fire Chief, Assistant Fire Chiefs, Battalion Chief, and Safety Officers, setting forth the authority, responsibilities, and compensation for each position.  The chain of command is established (from top to bottom) as follows: Fire Chief—Deputy Fire Chief—Assistant Fire Chiefs—Battalion Chief—Safety Officers, and further addresses command authority for those positions occupied by more than one person.  The ordinance contains a savings clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.

Fire Services Ordinance

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, PENNSYLVANIA, AMENDING THE BOROUGH’S CODE OF ORDINANCES BY MAKING CERTAIN AMENDMENTS TO CHAPTER 20 SOLID WASTE, TO REFLECT THE BOROUGH’S CURRENT COLLECTION PRACTICES FOR SOLID WASTE AND RECYCLING; REPEALING ALL PRIOR INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

The ordinance amends the Borough’s solid waste and recycling regulations as necessary to reflect the Borough’s current solid waste and recycling practices.  This includes amending the ordinance as necessary to reflect the use of Borough-issued collection containers.  The ordinance removes several references to practices no longer applicable to solid waste and recycling collection in the Borough.  The ordinance amends the regulations relating to the method of collection and the limitations placed thereon to reflect the Borough’s current use of Borough-issued collection containers, as well as the frequency of collection.  The ordinance clarifies the Borough’s right to perform audits of the Borough’s recycling program, including through a third-party.  The ordinance clarifies that both residential and nonresidential properties must recycle, and that nonresidential properties/units must establish a collection system in compliance with the ordinance.  The ordinance provides for the separation of electronic waste at all properties in the Borough (whether residential or non-residential), and requires all properties to dispose of electronic waste as set forth under the ordinance.  The ordinance clarifies that both residential and nonresidential properties are subject to the enforcement provisions of the ordinance, and makes failure to use the Borough-issued toters for recycling (where required by the ordinance) a violation.  The ordinance provides that fines and penalties will be automatically adjusted to comply with any limits established by state statute.  The ordinance contains a savings clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.
