Conshohocken Borough Council will consider adoption of the following ordinances at its public meeting on March 16, 2022, at 7:00 pm in Borough Hall, located at 400 Fayette Street, Conshohocken, PA 19428:

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING CHAPTER 13 LICENSES, PERMITS AND GENERAL BUSINESS REGULATIONS OF THE BOROUGH’S CODE OF ORDINANCES AT PART 13 PEDDLING; HANDBILLS BY REMOVING CERTAIN REGULATIONS; REPEALING PRIOR INCONSISTENT ORDINANCES AND PARTS OF ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; AND CONTAINING AN EFFECTIVE DATE.

In accordance with the requirements of the Borough Code, the following is a summary of the ordinance under consideration:

The ordinance amends the Borough’s regulations regarding Peddling/Handbills in the Borough.  The ordinance removes provisions related to the securing and checking of fingerprints of applicants for licenses under the regulations.  The ordinance contains a severability clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, ADOPTING, PURSUANT TO THE PENNSYLVANIA CONSTRUCTION CODE ACT, THOSE CERTAIN 2018 INTERNATIONAL CODES ADOPTED AS THE UNIFORM CONSTRUCTION CODE APPLICABLE IN THE COMMONWEALTH OF PENNSYLVANIA; AMENDING PART 2 PROPERTY MAINTENANCE OF CHAPTER 5 CODE ENFORCEMENT TO APPLY THE 2018 EDITION OF THE INTERNATIONAL PROPERTY MAINTENANCE CODE; REPEALING PRIOR INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; CONTAINING A SEVERABILITY CLAUSE AND A CLAUSE ADDRESSING FUTURE REVISIONS; AND PROVIDING AN EFFECTIVE DATE.

The ordinance adopts the most recent codes of the International Code Council adopted by the Pennsylvania Department of Labor and Industry as part of the Uniform Construction Code, pursuant to the Pennsylvania Construction Code Act.  The adoption includes, and is limited by, the changes made to said codes by the Department of Labor and Industry.  The following codes are adopted and made applicable in the Borough of Conshohocken, as modified by the Department of Labor and Industry: International Building Code of 2018; International Mechanical Code of 2018; International Fuel Gas Code of 2018; International Performance Code of 2018; International Plumbing Code of 2018; International Residential Code of 2018; International Fire Code of 2018 (to the extent adopted by the Department of Labor and Industry, which limited its adoption to the extent that the International Fire Code of 2018 is referenced by the other International Code Council Codes adopted by the Department); International Energy Conservation Code of 2018; International Existing Building Code of 2018; International Wildland-Urban Interface Code of 2018; and International Swimming Pool and Spa Code of 2018.  The ordinance amends the foregoing codes to reference the Borough of Conshohocken as the applicable municipality/jurisdiction. 

The ordinance also adopts the 2018 version of the International Property Maintenance Code as the property maintenance code applicable in the Borough of Conshohocken, and makes the following amendments thereto: (1) adding the name of the Borough as the applicable jurisdiction; (2) providing that Borough Council is to determine the applicable fees under the code by resolution; (3) setting the maximum permitted height of grass at 6 inches; (4) requiring insect screens from April 15 to October 15; (5) requiring a heat supply from October 15 to April 15 for properties with dwelling units or sleeping units; and (6) requiring a heat supply from October 15 to April 15 for indoor occupiable work spaces.  The ordinance contains a provision for fines and penalties, contains a severability clause, repeals prior inconsistent ordinances or parts of ordinances, sets an effective date, and provides for revisions thereunder.
