Borough Council of the Borough of Conshohocken will hold a public hearing and will consider the adoption of following ordinances at its meeting on 7:00 PM on Wednesday, June 15, 2022, in Borough Hall, located at 400 Fayette Street, Conshohocken, PA 19428.

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING THE CODE OF ORDINANCES OF THE BOROUGH OF CONSHOHOCKEN, CHAPTER 22 SUBDIVISION AND LAND DEVELOPMENT, PART 4 DESIGN STANDARDS, BY REPEALING SECTION 410 DRAINAGE IN ITS ENTIRETY AND REPLACING IT WITH A NEW SET OF PROVISIONS; REPEALING PRIOR INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE.

The following is a summary of the ordinance under consideration:

The ordinance amends the Borough’s Subdivision and Land Development Ordinance (“SALDO”), found at Chapter 22 of the Borough’s code of ordinances.  The ordinance amends the SALDO’s requirements related to stormwater management by repealing section 22-410 Drainage in its entirety and replacing the section with new provisions.  The ordinance contains a section identifying the purposes of the ordinance, and a section explaining the circumstances under which the ordinance applies.  The ordinance contains requirements regarding stormwater management and design and provides that the standards set forth in section 22-410 are minimum design standards and that federal, state, and other Borough laws and regulations also apply.  The ordinance requires compliance with section 22-410 before construction activities within the Borough may commence.  The ordinance requires that best management practices (BMPs) shall conform to state water quality requirements and more stringent Borough requirements as applicable.  The ordinance contains requirements regarding retention of existing watercourses and natural drainage features.  The ordinance contains requirements for site drainage plans, including general requirements, plan content requirements, and calculation requirements.  The ordinance contains storm sewer system design requirements, including applicable mathematical equations and formulas, storm sewer pipe design requirements, inlet and manhole design requirements, drainage channel and swale design requirements, endwall design requirements, bridge and culvert design requirements, and roof drain and sump pump design requirements.  The ordinance contains BMP design requirements, including storage requirements, compliance with the PA BMP Manual and use of sound and accepted engineering principles and practices.  The ordinance contains specific design criteria for infiltration BMPs, underground BMPs, bioretention BMPs, aboveground basin BMPs, primary spillway/outlet pipes, emergency spillways, and sediment basins and sediment traps.  The ordinance repeals inconsistent ordinances or parts of ordinances and contains a severability clause and an effective date.

2022 SALDO Stormwater Ordinance Amendment

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, PENNSYLVANIA, AMENDING CHAPTER 19 STORMWATER MANAGEMENT, OF THE BOROUGH’S CODE OF ORDINANCES BY REPEALING THE CURRENT PROVISIONS IN THEIR ENTIRETY AND REPLACING THEM WITH UPDATED PROVISIONS AMENDED TO BE CONSISTENT WITH THE PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION’S MODEL STORMWATER MANAGEMENT ORDINANCE AS PART OF THE SMALL MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) PERMIT PROGRAM; REPEALING ALL PRIOR INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

The following is a summary of the ordinance under consideration:

The ordinance repeals Chapter 19 Stormwater Management of the Borough’s code of ordinances in its entirety by replacing the current provisions with new provisions attached to the ordinance as exhibit “A” as the “Borough of Conshohocken Stormwater Management Ordinance” (“SWMO”), including appendices “A” and “B” thereto. 

Article I General Provisions of the SWMO contains the short title, the statement of findings, the purposes, the statutory authority, the SWMO’s applicability, the activities regulated under the SWMO, compatibility with other ordinance or legal requirements, and addresses erroneously issued/approved permits under the SWMO and requests for waivers under the ordinance.  Article II Definitions contains the ordinance’s interpretation standards and definitions.  Article III Stormwater Management Standards contains the SWMO’s general requirements for activities regulated under the SWMO, exemptions from the SWMO’s requirements, volume control requirements (including mathematical methods and equations therefor), and provisions for stormwater rate control.

Article IV Stormwater Management (SWM) Site Plan Requirements of the SWMO contains site plan requirements, site plan submission procedures, plan review procedures, procedures for modification of submitted site plans, procedures for resubmission of disapproved site plans, term of validity of approved plans and authorization to construct pursuant to an approved site plan, and requirements for as-built plans, completion certifications, and final inspections.  Article V Operation and Maintenance imposes responsibilities on developers and landowners for operation and maintenance of stormwater management facilities, requirements for operation and maintenance agreements, and requirements for performance guarantees.

Article VI Fees and Expenses contains the SWMO’s review and inspection fees and outlines the expenses covered by the fees.

Article VI Prohibition of the SWMO contains prohibitions against certain discharges and connections, restrictions for roof drains and sump pumps, and restriction against alteration of installed stormwater management BMPs.  Article VIII Enforcement and Penalties contains provisions related to the right of entry of Borough officials to access stormwater management facilities and BMPs for inspection, contains specific inspection requirements, and contains enforcement provisions under the SWMO, provisions for suspension and revocation of permits and approvals, provisions for violations and penalties under the SWMO, and appeal provisions under the SWMO.  Article IX of the SWMO contains the SWMO’s list of reference materials.  Appendix A of the SWMO contains the applicable stormwater coefficients.  Appendix B contains specifics regarding the SWMO’s “Simplified Approach to Stormwater Management for Small Projects.”
