TO THE RESIDENTS OF THE BOROUGH OF CONSHOHOCKEN:

NOTICE is hereby given that the Borough Council of the Borough of Conshohocken, Montgomery County, Pennsylvania, will consider adoption of the following ordinance at its public meeting on Wednesday, January 17, 2024, at 7:00 PM to be held at Borough Hall, 400 Fayette Street, Conshohocken, PA 19428.  The ordinance under consideration is as follows:

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING CHAPTER 25 TREES OF THE CODE OF THE BOROUGH OF CONSHOHOCKEN TO CLARIFY THE PERSON(S) AUTHORIZED TO ENFORCE THE PROVISIONS OF CHAPTER 25 TREES; FURTHER CLARIFYING HOW NOTICE OF VIOLATIONS PURSUANT TO SECTION 25-105 OBSTRUCTIONS WILL BE ISSUED; REPEALING PRIOR INCONSISTENT ORDINANCES AND PARTS OF ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; AND CONTAINING AN EFFECTIVE DATE. 

Pursuant to the requirements of the Borough Code, the following is a brief summary of the proposed ordinance:

The ordinance clarifies who is responsible for, and may, enforce the provisions of Chapter 25 Trees.  Under the ordinance, the Municipal Arborist, Code Enforcement Official, or such other designee of the Borough is given responsibility and authority to enforce Chapter 25 Trees.  The ordinance further clarifies that an order issued pursuant to Section 25-105 Obstructions will be served by mailing a copy of the order to the last known address of the property owner.  The ordinance contains a severability clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.
