Borough Council will hold a public hearing and will consider the adoption of an ordinance amending the Conshohocken Zoning Ordinance as set forth below, at 7:00 PM on Wednesday, February 7, 2024, in Borough Hall, located at 400 Fayette Street, Conshohocken, PA 19428.

Main Street Overlay Ordinance

In accordance with the requirements of the Pennsylvania Municipalities Planning Code, the following is a summary of the proposed ordinance:

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING THE CODE OF ORDINANCES OF THE BOROUGH OF CONSHOHOCKEN, CHAPTER 27 ZONING BY ADDING A NEW PART 23, FAYETTE STREET CORRIDOR OVERLAY DISTRICT; AMENDING THE ZONING MAP FOR THE BOROUGH OF CONSHOHOCKEN TO INCLUDE THE FAYETTE STREET CORRIDOR OVERLAY DISTRICT; REPEALING PRIOR INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE.

The ordinance creates an overlay district over properties with frontage along certain parts of Fayette Street, called the Fayette Street Corridor Overlay (FCO) District (the “Overlay”). The Overlay contains three zones: Zone One (Elm Street on the east side of Fayette Street and 1st Avenue on the west side of Fayette Street up to 4th Avenue); Zone Two (4th Avenue to 9th Avenue); and Zone Three (9th Avenue to 12th Avenue). The ordinance sets forth the legislative intent of the Overlay. The ordinance contains a table of permitted uses, explaining what uses are permitted in each Zone. The ordinance contains use-specific requirements for certain permitted uses. The ordinance contains area and dimensional requirements and sets those requirements by Zone.  The ordinance includes requirements for a civic/public plaza for projects where at least 15,000 square feet of nonresidential space is developed. The ordinance contains general requirements applicable to all projects under the Overlay, including architectural design requirements and sign regulations. The ordinance has off-street parking requirements. The ordinance includes a section resolving conflicts between the application of the Overlay provisions as compared to the underlying zoning district provisions. The ordinance adds specific definitions applicable to the Overlay to the Zoning Ordinance’s definition section. The ordinance amends the Borough’s zoning map to the extent needed to reflect the existence of the new Overlay. The ordinance repeals prior inconsistent ordinances or parts of ordinances, contains a savings clause, and sets an effective date.
