NOTICE is hereby given that the Borough Council of the Borough of Conshohocken, Montgomery County, Pennsylvania, will consider adoption of the following ordinance at its public meeting on Wednesday, July 17, 2024, at 7:00 p.m., to be held at Borough Hall, 400 Fayette Street, Conshohocken, PA 19428.  The ordinance under consideration is as follows:

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING CHAPTER 13 LICENSES, PERMITS AND GENERAL BUSINESS REGULATIONS OF THE CODE OF THE BOROUGH OF CONSHOHOCKEN BY AMENDING PART 7 FOOD VENDORS, ARTICLE A FOOD VENDOR REGULATIONS TO CLARIFY THE AREAS OF THE BOROUGH WITHIN WHICH FOOD VENDORS ARE PERMITTED AND TO OTHERWISE CLARIFY THE PROCEDURES AND REQUIREMENTS ASSOCIATED WITH FOOD VENDOR LICENSES IN THE BOROUGH; REPEALING PRIOR INCONSISTENT ORDINANCES AND PARTS OF ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; AND CONTAINING AN EFFECTIVE DATE.

Complete Proposed Food Vendor Ordinance Amendment

Pursuant to the requirements of the Borough Code, the following is a brief summary of the proposed ordinance:

The ordinance amends the regulations related to food vendors under Chapter 13 Licenses, Permits and General Business Regulations of the Borough’s Code of Ordinances.  The ordinance contains definitions applicable to the food vendor regulations, and clarifies the requirements for food vendors to obtain a license from the Borough, including required County licensure, insurance, background checks, and fire suppression systems/extinguishers, as well as clarifying the information required to be submitted with an application for a food vendor license.  The ordinance clarifies the requirement for an inspection prior to issuance of a food vendor license, and provides for a fee for the license.   The ordinance clarifies that food vendors are subject to inspection after issuance of a license, that the license must be posted at all times in the food-vending vehicle, and that licenses may not be transferred from one vendor/business to another.  The ordinance provides for expiration of food vendor licenses.  The ordinance imposes certain food vendor employee standards.  The ordinance contains hours and location limitations, and clarifies that food vendors are only permitted in the SP-1 Specially Planned District 1, SP-2 Specially Planned District 2, and SP-3 Specially Planned District 3 zoning districts of the Borough, unless the hours and location requirements are exempted from the hours and location requirements by the ordinance or waived by Borough Council pursuant to the requirements of the ordinance.  The ordinance contains penalties for violation of the ordinance.  The ordinance contains a severability clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.
